1 Definities:
In deze Privacy Statement hebben de navolgende begrippen de volgende betekenis:
a. AVG: De Algemene Verordening Gegevensbescherming;
b. Persoonsgegevens: alle informatie over een geïdentificeerde of identificeerbare natuurlijke persoon, zoals gedefinieerd in artikel 4 AVG;
c. Privacy Statement: deze privacy verklaring van Get Responsive;
d. Verwerker: een natuurlijke persoon of rechtspersoon, een overheidsinstantie, een dienst of een ander orgaan die/dat ten behoeve van de verwerkingsverantwoordelijke persoonsgegevens verwerkt, zoals bedoeld in de AVG;
e. Website: de website van Get Responsive onder andere de domeinnaam: https://www.Get- Responsive.com
2 Verwerken van Persoonsgegevens
2.1 Get Responsive verzamelt Persoonsgegevens als u ervoor kiest om deze aan Get Responsive beschikbaar te stellen al dan niet in het kader van de uitvoering van een overeenkomst met u, bijvoorbeeld door het achterlaten van uw e-mailadres of door het registeren van interesses voor bepaalde diensten die Get Responsive aanbiedt. Het kan zijn dat u eerder Persoonsgegevens hebt verstrekt aan Get Responsive (bijvoorbeeld als u al een klant bent of al eens klant bent geweest).
2.2 Get Responsive verwerkt Persoonsgegevens in ieder geval voor/op de volgende wijze:
• Uitvoering van de overeenkomst, werkzaamheden of opdracht
• Bezoek Website
• Nieuwsbrieven
• Marketingdoeleinden
• Social Media
• Aanvraag informatie of offerte
• Werving en selectie personeel
• Registratie voor klassikale en online trainingen, online via Power Up
• Informatie die door u of uw adviseur aan ons kantoor verstrekt wordt.
2.3 Get Responsive verwerkt in de regel alleen informatie die minimaal nodig is om onze werkzaamheden uit te kunnen voeren. In gevallen waarin u om verplichte informatie wordt gevraagd, wordt u daarvan op de hoogte gesteld.
2.4 Indien u gebruik maakt van onze dienstverlening, is het mogelijk dat u bepaalde Persoonsgegevens van u zelf op eigen initiatief verstrekt c.q. bepaalde Persoonsgegevens van u zelf dient te verstrekken. Deze verzameling vindt bijvoorbeeld plaats in de volgende gevallen:
• bij een bezoek aan de Website slaan de servers automatisch (geanonimiseerde) informatie op, zoals URL, IP-adres, browsertype en -taal, datum en tijd van bezoek (‘Bezoekgegevens’), één en ander conform artikel 6.
• voor een verzoek om (nadere) informatie en/of het aanmelden voor de digitale nieuwsbrief verwerkt Get Responsive de daarvoor door u verstrekte contactgegevens (zoals naam en e- mailadres).
• als u ons via de Website aangeeft dat u geïnteresseerd ben in werken bij Get Responsive of als u ons een curriculum vitae stuurt om te solliciteren op een van de vacatures van Get Responsive, dan zal Get Responsive uw Persoonsgegevens gebruiken, één en ander conform artikel 4.
• om een persoonlijke account op de Website aan te maken, dient u uw (volledige) naam, adres, e-mailadres en wachtwoord te verstrekken, ten behoeve van de registratie voor bepaalde onderdelen van de Website.
3 Wettelijke Grondslagen voor de Verwerking
3.1 Als Get Responsive uw Persoonsgegevens verwerkt, berust deze verwerking op een van de volgende grondslagen:
• uw Persoonsgegevens kunnen worden verwerkt indien dat noodzakelijk is voor de uitvoering van een overeenkomst met u;
• de verwerking van uw Persoonsgegevens is noodzakelijk om te voldoen aan wettelijke verplichtingen;
• uw Persoonsgegevens kunnen worden verwerkt op basis van een gerechtvaardigd belang van Get Responsive. Deze verwerking is toegestaan zolang uw belangen niet zwaarder wegen. Van een gerechtvaardigd belang kan bijvoorbeeld sprake zijn bij verwerkingen met als doel:
• marketing;
• het werven van opdrachten (sales) in geval van bestaande klanten waar Get Responsive een commerciële relatie mee heeft;
• het beheren van bestaande klanten en relaties (relatiebeheer);
• het optimaliseren of personaliseren van content (van de Website);
• het operationele proces om deelnemers aan leeromgeving Power Up toe te voegen of te informeren over inactiviteit, nieuwe trainingen of naderen einddatum abonnement
• het voeren en optimaliseren van een effectieve bedrijfsvoering.
• U hebt specifiek een expliciet toestemming verleend om Persoonsgegevens van u te verwerken voor een bepaald doel. We zullen uw Persoonsgegevens dan uitsluitend verwerken voor dat doel waarvoor we uw toestemming hebben verkregen, in voornoemd geval kunt u uw gegevens toestemming op elk gewenst moment intrekken.
4 Werving
4.1 Omdat Get Responsive de Website ook als wervingsinstrument gebruikt, kunt u tijdens een bezoek aan de Website uw curriculum vitae aan Get Responsive sturen. De door u verstrekte Persoonsgegevens in dit kader worden door Get Responsive uitsluitend voor de volgende doeleinden gebruikt:
• voor wervings- en selectiedoeleinden binnen Get Responsive;
• voor communicatiedoeleinden, bijvoorbeeld voor het maken van een afspraak indien Get Responsive u wil uitnodigen voor een kennismakings- of sollicitatiegesprek;
• in geval uw sollicitatie in behandeling is genomen voor de beoordeling van uw geschiktheid voor een functie bij Get Responsive die vacant is of kan worden.
5 Bijzondere Persoonsgegevens
5.1 Bijzondere persoonsgegevens, zoals gedefinieerd in de AVG, worden alleen door Get Responsive verzameld wanneer u deze vrijwillig heeft verstrekt of wanneer dit op grond van wet- en/of regelgeving noodzakelijk of toegestaan is. Onder bijzondere persoonsgegevens wordt in ieder geval verstaan etniciteit, politieke gezindheid, religie, levensovertuiging, gezondheid of seksuele geaardheid. Als u bijzondere persoonsgegevens, om welke reden dan ook, aan Get Responsive verstrekt, gaat Get Responsive er van uit dat u Get Responsive expliciet toestemming geeft om die informatie te verwerken.
6 Automatisch verzamelen van Persoonsgegevens
6.1 IP-adres.
Een IP-adres is een nummer toegewezen aan uw computer wanneer u. Toegang tot het internet verkrijgt. Het biedt computers en servers de mogelijkheid om u te herkennen en met andere te communiceren. IP-adressen van waaruit bezoekers afkomstig lijken te zijn, kunnen door Get Responsive worden geregisterd voor IT-beveiliging en diagnostische doeleinden. Deze informatie kan ook in geaggregeerde vorm door Get Responsive worden gebruikt om trends in het gebruik van de Website te herkennen en om performance analyses uit te voeren.
6.2 Cookies.
Om de Website goed te laten functioneren, maakt Get Responsive onder andere gebruik van functionele- en analytische cookies. Cookies zijn kleine tekstbestanden die een computer opslaat als een website wordt bezocht. De cookie onthoudt wat u invult op de website voor een volgend bezoek, zodat de inhoud van de website op de desbetreffende gebruiker kan worden afgestemd en het niet nodig is dat persoonsgegevens opnieuw worden ingevuld. De meeste browsers zijn standaard ingesteld om cookies te accepteren, maar u kunt uw browser instellen om alle cookies te weigeren of om aan te geven wanneer een cookie wordt verzonden. Het is echter mogelijk dat sommige functies en services op de Website van Get Responsive, niet correct functioneren als cookies zijn uitgeschakeld in uw browser.
Voor meer gedetailleerde informatie over de specifieke cookies die we gebruiken, verwijzen we u naar de lijst van cookies hieronder die we mogelijk verzamelen tijdens uw bezoek:
• Analytische cookies (bv. _ga, _gat, _gid)
• Functionele cookies (bv. _hjSessionUser, li_mc, li_sugr)
• Cookies voor facturatiebeheer (bv. mp_mollie, sbjs_current)
• Cookies voor gebruikersinteractie en identificatie (bv. _uetvid, bcookie)
6.3 Web beacons,
Get Responsive adverteert op websites van derden. Om het succes van reclames te meten, kan Get Responsive hierbij gebruik maken van technologie voor bezoekersherkenning met namen als ‘web beacons’ of ‘action tags’ die het aantal bezoekers tellen die op de Website zijn terechtgekomen nadat hen op de website van de derde een Get Responsive advertentie is getoond. Get Responsive gebruikt deze technologie niet om Persoonsgegevens te verkrijgen, maar zij gebruikt die om de effectiviteit van de advertenties te meten.
6.4 Door gebruik te maken van de Website stemt u in met het plaatsen van cookies en web beacons op uw computer of mobiele apparaat. Wilt u geen cookies of web beacons ontvangen, dan moet u de Website niet meer bezoeken of de instellingen van uw browser zodanig aanpassen.
7 Software Tools en Social Media
7.1 Get Responsive maakt gebruik van software tool Google Analytics, een webanalyse-service die wordt aangeboden door Google Inc. (‘Google’). Google Analytics wordt gebruikt voor analyse en verbetering van het gebruik van de Website.
7.2 Get Responsive heeft een verwerkingsovereenkomst met Google gesloten.
7.3 Ook heeft Get Responsive het laatste octet van IP-adressen gemaskeerd[TG1], zodat er geen volledige IP-adressen door Google Analytics worden verzameld. Verder zijn alle opties met betrekking tot het delen van gegevens met Google in Google Analytics uitgezet. Ten slotte maakt Get Responsive geen gebruik van andere Google-diensten in combinatie met Google Analytics.
7.4 Google biedt door middel van een browserextensie een opt-out
7.5 Mogelijkheid voor Google-Analytics, zodat wordt voorkomen dat uw gegevens worden gebruikt voor Google Analytics. Indien u hier gebruik van wilt maken kunt u de browserextensie hier downloaden.
7.6 Het kan zijn dat middels deze software tools Persoonsgegevens van u worden verzameld, welke vervolgens worden geanonimiseerd en niet te herleiden zijn naar u. U wordt aangeraden de privacy statements behorend bij deze software tools (die regelmatig kunnen wijzigen) te lezen, om te zien wat zij met deze gegevens doen.
7.7 De software tools mogen de via hun cookies verzamelde informatie aan derden verschaffen indien zij hiertoe wettelijk worden verplicht, of voor zover deze derden de informatie namens (een van) hen verwerken. De software tools stellen zich te houden aan de aldaar geldende privacyregelgeving. Dit houdt in dat sprake zou zijn van een passend beschermingsniveau voor de verwerking van (persoons)gegevens. Get Responsive is hiervoor niet verantwoordelijk en sluit alle aansprakelijkheid hieromtrent uit.
8 E-mail
8.1 Via diverse manieren kunnen ook e-mail berichten verzonden worden. In de berichten die op deze manier verzonden worden, kan uw e-mailadres vermeld staan, evenals eventuele aanvullende informatie die u in het bericht opneemt. Indien u via een e-mail een verzoek of opmerkingen tot ons richt, is het mogelijk dat Get Responsive vermelde Persoonsgegevens verstrekt om bijvoorbeeld contact met u op te nemen voor/ter beoordeling van uw e-mailadres.
9 Direct marketing
9.1 Behalve voor bijvoorbeeld mailinglijsten, waarvoor u zich kunt opgeven en waarbij u kunt aangeven dat u specifiek marketingmateriaal, andere publicaties en/of informatie van Get Responsive wenst te ontvangen, zal Get Responsive uw Persoonsgegevens niet ter ondersteuning van haar direct marketing activiteiten aanwenden.
10 Derden
10.1 Get Responsive heeft voor de in deze Privacy Statement opgesomde verwerkingsdoeleinden meerdere Verwerkers ingeschakeld, met wie zij diverse verwerkingsovereenkomsten heeft gesloten die erop toezien dat de Verwerkers voldoende waarborgen bieden ten aanzien van technische- en organisatorische beveiligingsmaatregelen met betrekking tot de te verrichten verwerkingen.
10.2 Get Responsive kan Persoonsgegevens delen met andere adviseurs of externe partijen indien dit vereist is in het kader van de uitvoering van de overeenkomst met u en uitsluitend na expliciete toestemming van u.
10.3 Get Responsive kan uw Persoonsgegevens delen met externe bedrijven of dienstverleners die namens ons werken om uw verzoeken te kunnen inwilligen. Alsdan zal er met de betreffende derde partijen een passend (verwerkers)overeenkomst gesloten worden waarin onder andere een juiste en veilige verwerking van Persoonsgegevens is gewaarborgd.
10.4 Get Responsive kan ook Persoonsgegevens opslaan in een ander land dan waar u bent gevestigd of woonachtig bent. Indien en voor zover door Get Responsive Persoonsgegevens worden doorgegeven naar het buitenland, vindt dit plaats in overeenstemming met Europese (en Nederlandse) privacywetgeving.
10.5 Get Responsive kan Persoonsgegevens verwerken in verband met de verkoop of overdracht van de dienstverlening in het kader waarvan de Persoonsgegevens worden verstrekt.
10.6 Get Responsive is bovendien in bepaalde situaties verplicht om Persoonsgegevens openbaar te maken, denk hierbij aan een wettelijk voorschrift, een gerechtelijk bevel of overheidsbesluit.
10.7 Uw Persoonsgegevens kunnen noodzakelijk zijn voor privacy- of veiligheidsaudits of om een onderzoek uit te kunnen voeren naar aanleiding van een klacht of bedreiging van de veiligheid. Get Responsive zal hieraan gehoor geven.
10.8 Get Responsive verkoopt geen Persoonsgegevens aan derden.
10.9 Voor het overige zal Get Responsive uw Persoonsgegevens niet aan derden verstrekken, tenzij dit noodzakelijk is voor de uitvoering van haar dienstverlening, op grond van een wettelijk voorschrift of in een noodgeval, voor zover dat naar het redelijke oordeel van Get Responsive in uw belang is.
11 Externe links
11.1 Get Responsive heeft links naar de website van derden opgenomen. Als u via zo’n link naar een andere website gaat, geldt het Privacy Statement daar niet meer. Het kan gebeuren dat deze derden of anderen op deze websites informatie over u verzamelen. Get Responsive is niet verantwoordelijke
voor de inhoud van deze websites noch voor de handelingen van deze derden en anderen. Wij raden u aan om het privacy statement van deze websites door te lezen alvorens (Persoons)gegevens te verstrekken.
12 Rechten met betrekking tot de verzamelde gegevens
a. U hebt het recht om inzage te krijgen in uw Persoonsgegevens, die Get Responsive van u verwerkt. Hiervoor kunt u Get Responsive vragen welke gegevens zijn geregisterd en waarvoor ze worden gebruikt. Onderaan deze Privacy Statement vind u onze contactgegevens.
b. U hebt het recht om de Persoonsgegevens die Get Responsive van u heeft verzameld, te laten corrigeren, wijzigen of aanvullen indien deze onjuist dan wel onvolledig zijn.
c. In een aantal wettelijk bepaalde gevallen hebt u het recht uw Persoonsgegevens te laten verwijderen.
d. In een aantal wettelijk bepaalde gevallen hebt u het recht om minder Persoonsgegevens door Get Responsive te laten verwerken.
e. In een aantal wettelijk bepaalde gevallen hebt u het recht om uw Persoonsgegevens over te laten dragen aan derden.
f. U hebt het recht om bezwaar te maken tegen de verwerking van uw Persoonsgegevens door Get Responsive.
g. U hebt het recht een klacht in te dienen bij een toezicht houdende autoriteit.
h. Indien u zelf toestemming hebt gegeven voor de verwerking van uw Persoonsgegevens mag u deze toestemming te allen tijde intrekken. Hiervoor kunt u een verzoek sturen naar Get Responsive.
i. Indien u zich eerder hebt aangemeld voor nieuwsbrieven en u wilt die niet meer ontvangen, dient u zich hiervoor apart af te melden via de betreffende link in de e-mail.
13 Bewaartermijn
13.1 Get Responsive bewaart uw Persoonsgegevens niet langer dan noodzakelijk is voor de uitvoering van haar (Online) diensten tenzij zij op grond van wettelijke bepalingen verplicht is Persoonsgegevens langer te bewaren.
13.2 Wij hebben met onze hostingpartner WPProvider passende technische en organisatorische maatregelen genomen om je gegevens te beschermen tegen onrechtmatige verwerking. Voor meer informatie over onze gegevensbeveiligingspraktijken, kunt je contact met ons opnemen.
14 Beveiliging
14.1 Get Responsive heeft passende technische- en organisatorische maatregelen getroffen om uw Persoonsgegevens te beveiligen tegen verlies of onrechtmatige verwerking, waaronder:
• opslag van die gegevens in een beveiligde database met versleutelde wachtwoorden en beveiligde back-ups;
• Toegang tot de eigen gegevens via een persoonlijk account door een unieke gebruikersnaam en wachtwoord;
• alle werknemers van Get Responsive dienen zich aan de beveiligingsvoorschriften te houden die voor de gehele organisatie gelden;
• Persoonsgegevens zijn uitsluitend toegankelijk voor geautoriseerde werknemers van Get Responsive, en deze werknemers hebben zich er toe verplicht om de vertrouwelijkheid van deze informatie te waarborgen.
14.2 Ondanks dat Get Responsive alle passende beveiligingsmaatregelen heeft genomen en zal nemen, zijn aan de verwerking van uw Persoonsgegevens risico’s verbonden die inherent zijn aan bijvoorbeeld het gebruiken van internet in het maatschappelijk verkeer.

In this Privacy Statement, the following terms have the following meanings:

2 Definitions:
2.1 Get Responsive collects Personal Data if you choose to make it available to Get Responsive, whether or not in the context of the execution of an agreement with you, for example by leaving your e-mail address or by registering interests for certain services that Get Responsive offers. You may have previously provided Personal Data to Get Responsive (for example, if you are already a customer or have been a customer before).
2.2 Get Responsive processes Personal Data in any case for/in the following way:
• Execution of the agreement, work or assignment
• Visit Website
• Newsletters
• Marketing purposes
• Social Media
• Request information or quotation
• Recruitment and selection of personnel
• Registration for classroom and online training, online via Power Up
• Information provided to our office by you or your advisor.
2.3 As a rule, Get Responsive only processes information that is minimally necessary to be able to carry out our work. In cases where you are asked for mandatory information, you will be informed.
2.4 If you make use of our services, it is possible that you provide certain Personal Data about yourself on your own initiative or that you are required to provide certain Personal Data of yourself. This collection takes place, for example, in the following cases:
• when visiting the Website, the servers automatically store (anonymised) information, such as URL, IP address, browser type and language, date and time of visit (‘Visit Data’), all in accordance with Article 6.
• For a request for (further) information and/or to register for the digital newsletter, Get Responsive processes the contact details provided by you (such as name and e-mail address).
• if you indicate to us via the Website that you are interested in working at Get Responsive or if you send us a curriculum vitae to apply for one of Get Responsive vacancies, Get Responsive will use your Personal Data in accordance with Article 4.
• In order to create a personal account on the Website, you must provide your (full) name, address, e-mail address and password, for the purpose of registering for certain parts of the Website.
3 Legal Bases for Processing
3.1 If Get Responsive processes your Personal Data, this processing is based on one of the following bases:
• your Personal Data may be processed if it is necessary for the performance of an agreement with you;
• the processing of your Personal Data is necessary to comply with legal obligations;
• your Personal Data may be processed on the basis of a legitimate interest of Get Responsive. This processing is permitted as long as your interests do not outweigh your interests. For example, there may be a legitimate interest in processing for the purpose of:
• marketing;
• acquiring assignments (sales) in the case of existing customers with whom Get Responsive has a commercial relationship;
• managing existing customers and relations (relationship management);
• optimising or personalising content (of the Website);
• the operational process to add participants to the Power Up learning environment or to inform them about inactivity, new training courses or approaching the end date of the subscription
• conducting and optimising effective business operations.
• You have specifically given an explicit consent to process Personal Data about you for a particular purpose. We will then only process your Personal Data for the purpose for which we have obtained your consent, in which case you can withdraw your consent at any time.
4 Recruitment
4.1 Because Get Responsive also uses the Website as a recruitment tool, you can send your curriculum vitae to Get Responsive during a visit to the Website. The Personal Data provided by you in this context will only be used by Get Responsive for the following purposes:
• for recruitment and selection purposes within Get Responsive;
• for communication purposes, for example to make an appointment if Get Responsive wants to invite you for an introductory or job interview;
• in the event that your application has been considered for the assessment of your suitability for a position at Get Responsive that is or may become vacant.
5 Sensitive personal data
5.1 Special categories of personal data, as defined in the GDPR, are only collected by Get Responsive when you have provided them voluntarily or when this is necessary or permitted by law and/or regulation. Special categories of personal data include ethnicity, political affiliation, religion, belief, health or sexual orientation. If, for whatever reason, you provide sensitive personal data to Get Responsive, Get Responsive assumes that you give Get Responsive explicit permission to process that information.
6 Automatic Collection of Personal Data
6.1 IP address.
An IP address is a number assigned to your computer when you use it. Access the Internet. It provides computers and servers with the ability to recognize you and communicate with others. IP addresses from which visitors appear to originate may be logged by Get Responsive for IT security and diagnostic purposes. This information may also be used in aggregate form by Get Responsive to recognize trends in the use of the Website and to perform performance analyses.
6.2 Cookies.
In order for the Website to function properly, Get Responsive uses functional and analytical cookies, among other things. Cookies are small text files that a computer stores when a website is visited. The cookie remembers what you enter on the website for your next visit, so that the content of the website can be tailored to the respective user and it is not necessary to re-enter personal data. Most browsers are set to accept cookies by default, but you can set your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services on the Get Responsive Website may not function properly if cookies are disabled in your browser.

Get Responsive advertises on third-party websites. In order to measure the success of advertisements, Get Responsive may use visitor recognition technology with names such as ‘web beacons’ or ‘action tags’ that count the number of visitors who have arrived at the Website after being shown a Get Responsive advertisement on the third party’s website. Get Responsive does not use this technology to obtain Personal Data, but it uses it to measure the effectiveness of the advertisements.
6.4 By using the Website, you consent to the placement of cookies and web beacons on your computer or mobile device. If you do not wish to receive cookies or web beacons, you should stop visiting the Website or adjust your browser settings accordingly.
7 Software Tools and Social Media
7.1 Get Responsive uses software tool Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics is used to analyse and improve the use of the Website.
7.2 Get Responsive has entered into a data processing agreement with Google.
7.3 Also, Get Responsive has masked the last octet of IP addresses[TG1], so that no full IP addresses are collected by Google Analytics. Furthermore, all options regarding the sharing of data with Google in Google Analytics have been disabled. Finally, Get Responsive does not use other Google services in combination with Google Analytics.
7.4 Google offers an opt-out by means of a browser extension
7.5 Possibility for Google Analytics, so that your data is not used for Google Analytics. If you want to make use of this, you can download the browser extension here.
